  • Temporary Deferral of Local Infrastructure Contributions 2024

On 1st May 2024, Council resolved to temporarily defer the timing of local infrastructure contributions (Section 7.11 and 7.12) payment that is usually required to be paid prior to the issue of a Construction Certificate. The changes will allow for the timing of payment to be deferred to prior to the issue of the first Occupation Certificate for any part of the development for a 2 year deferral period from 1 July 2024 to 30 June 2026.

The temporary deferral arrangement will apply to all development applications within the Council’s local government area, provided that a Construction Certificate is lodged within the 2 year deferral period. For a development to receive a deferral of local infrastructure contributions, an application to request the deferral must be made to Council.

The provision of indexation in line with the Cumberland Local Infrastructure Contributions Plan 2020 will not be excluded from the deferred contributions.

Section 6.10 of the Environmental Planning and Assessment Act 1979 requires that an Occupation Certificate for any part of a development must not be issued until the contributions or levies have been paid. The certifying authority must obtain written confirmation from Council that the contributions or levies have been paid before issuing the Occupation Certificate.

For further information on the deferral of contributions scheme, please contact Council’s Planning Systems team on 8757 9000, or email council@cumberland.nsw.gov.au.

For more information on development contributions, and for relevant documents, see the council website.
